Terms of Service

1. Agreement to Terms

By accessing or using Noisy Pixel's website and services ("Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services. Noisy Pixel is a brand of B5 Services Group LLC ("Company," "we," "us," or "our").

2. Description of Services

Noisy Pixel provides AI-powered digital tools and services for home service contractors, including but not limited to AI voice receptionist services, AI chatbot services, CRM and automation tools, contractor website design and hosting, and Google Business Profile management.

3. Service Plans and Billing

• Monthly subscriptions: Services are billed monthly in advance. Subscriptions renew automatically unless cancelled.
• Setup fees: One-time setup fees are charged upon service activation and are non-refundable after setup is complete.
• Cancellation: You may cancel your subscription with 30 days written notice. Service continues through the end of the paid period.
• Price changes: We will provide 30 days notice of any price increases.

4. Acceptable Use

You agree not to use our Services to:

• Violate any applicable laws or regulations
• Transmit spam, phishing, or fraudulent communications
• Infringe on intellectual property rights
• Engage in deceptive or misleading business practices
• Interfere with or disrupt the Services

5. Client Responsibilities

You are responsible for:

• Providing accurate business information during setup
• Maintaining the confidentiality of any account credentials
• Complying with applicable telecommunications regulations for AI call handling in your jurisdiction
• Ensuring your use of AI voice features complies with local call recording and disclosure laws
• Maintaining up-to-date payment information

6. Intellectual Property

All content, branding, and technology within the Noisy Pixel platform remains the property of B5 Services Group LLC. Custom content created for your business (scripts, website copy, brand configurations) belongs to you upon full payment.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, B5 SERVICES GROUP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICES.

Our total liability for any claim arising from these Terms shall not exceed the amounts you paid us in the three months preceding the claim.

8. Warranty Disclaimer

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SPECIFIC RESULTS WILL BE ACHIEVED.

We cannot guarantee specific revenue increases or lead generation outcomes. Results vary based on your market, business operations, and other factors outside our control.

9. Third-Party Services

Our Services integrate with third-party platforms (Google, Firebase, Cal.com, and others). Your use of these integrations is subject to those parties' terms of service. We are not responsible for third-party service availability or changes.

10. Termination

We reserve the right to suspend or terminate your access to Services immediately, without notice, for material violations of these Terms or non-payment. You may terminate at any time with 30 days written notice per Section 3.

11. Governing Law

These Terms are governed by the laws of the state in which B5 Services Group LLC is registered, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with AAA Commercial Arbitration Rules.

12. Changes to Terms

We may update these Terms from time to time. We will provide 14 days notice of material changes via email or website notice. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
